The Rules: Terms of Use

The deadline for Entrants to take part in this competition has been extended until 11:59pm (BST) Thursday 16 August 2012. All other Rules as set out below shall remain the same.

Entrants are reminded that they may enter the competition as many times as they wish and that they may re-submit previous entries for consideration within the extended deadline.  


The promoter of this competition is Livity Limited (“Promoter” / “Livity”). Livity is a company registered in the United Kingdom whose principal place of business is Piano House, 9 Brighton Terrace, London, SW9 8DJ.

The terms and conditions of this competition are set out below (the “Rules”).


  1. This competition shall run on (“Website”).

  1. This competition is open to UK residents (including Channel Islands & Isle of Man residents) aged 18 and over on 19 July 2012, except employees of the Promoter, Big Lottery Fund and their families (“Entrant(s)”). Entrants under the age of 18 must get the written consent of their parent or guardian to enter the competition and be able to provide evidence of the same to the Promoter on request.

  1. The Promoter reserves the right to take steps to verify the eligibility of Entrants and for these purposes, the Promoter may require such information as it considers necessary. The prize may be withheld until and unless the Promoter is satisfied with the verification.

  1. Each Entrant may enter the competition as often as they wish, provided that each entry is different and complies with the Rules.

  1. To enter, Entrants must record a vocal or instrumental recording (“Recording”) that can be added to the Peace Mix track (“Track”) which complies with the “peace brief” as fully detailed on the Website. Entrants must upload their Recording in the form of a Soundcloud or YouTube recording as detailed on the Website.

  1. Regardless of whether Entrants enter via YouTube or Soundcloud, Entrants must include their first name, surname, date of birth, email address, phone number and entry link (“Entrant’s Information”) when submitting the online entry form.  Any entries made without the Entrant’s Information completed shall not be entered into the competition.

  1. The Track is covered by a Creative Commons Licence. Therefore, by entering the competition each Entrant hereby acknowledges and accepts that they will comply with the terms of the Creative Commons Licence a copy of which can be found at and where the main terms can be viewed. The Creative Commons Licence provides that any third party using the Track has to comply with certain considerations. In particular, this provides that third parties, including the Promoter, can remix, tweak, and build upon each Entrant’s work non-commercially, so long as such third party including the Promoter, credits the Entrant for their contribution.

  1. By entering the competition each Entrant hereby acknowledges that if he or she is selected as a winner:

  • the Recording may be featured on the Track;

  • the Track may be available on the Website or other third party websites as a free download;

  • the Entrant shall attend the finale at the Roundhouse on 28 August 2012 and take part in the professional recording of their entry and video accompanying their entry (“Final Entry and Video”); and

  • the Promoter, its licensees, subsidiaries and/or assignees shall have the right to exploit the Final Entry and Video in any manner and all media as Promoter sees fit.

  1. By entering and submitting an entry, all eligible Entrants agree to abide by each and all of the Rules and the Security and Privacy Policy ( that govern the Website.

  1. The Use of Entrant’s Information will be compliant with all data protection laws and legislation and the Website privacy policy. Entrant’s contact details will not be passed on for use by any third parties, and Entrants will only be contacted in reference to competition.

  1. The Promoter accepts no responsibility for difficulties experienced in submitting an entry to the competition. The Promoter will not be liable for any failure of receipt of entries. The Promoter takes no responsibility for any entries that are lost, delayed, illegible, corrupted, damaged, incomplete or otherwise invalid. Further, the Promoter will not be liable for technical, hardware, or software failures of any kind or lost or unavailable network connections which may limit or prohibit an eligible Entrant’s ability to participate in the competition.  Proof of submission will not be accepted as proof of receipt.

  1. Entries may be rejected at the sole discretion of the Promoter, including (but not limited to) reasons of obscenity, defamation, invasion of privacy, a violation of the rights of a third party or in the event that the Promoter deems the entry uploaded to be in anyway inappropriate (including on grounds of discrimination and/or sexual content). The Promoter reserves the right to reject any entry and/or to require Entrants to provide proof of their age and/or parental/guardian consent, and to withdraw such Entrant’s entry from the competition if the Entrant does not provide such proof within 48 hours from the Promoters request.

  1. The closing date for the competition is 11:59pm (BST) Thursday 16 August 2012. Entries received after this time will not be entered into the competition regardless of the reason. Incomplete entries will not be considered.

  1. The Entrant represents, warrants and undertakes that the entry submitted is the Entrant’s original work and it does not breach any agreement between the Entrant and any third party. The Entrant warrants that the entry does not infringe upon or breach any law, agreement, licence, copyright or other rights of any third party. The Entrant hereby indemnifies the Promoter against all loss, damage and costs howsoever arising caused by an Entrant’s entry infringing the rights of any third party or other breach of any terms of the Rules. The Entrant agrees to waive and/or not assert any moral rights against the Promoter, its licensee, subsidiaries and/or assigns.

  1. By submitting an entry the Entrant hereby: assigns to the Promoter  (subject to the terms of the Creative Commons Licence) all copyright and other intellectual property rights (including the making available right) in such Recordings and performance, including in the Final Entry and Video, with full title guarantee to the extent that the Promoter shall own the same throughout the world for the full duration of such rights; and consents and agrees to the inclusion of the Entrant’s performance in the Recordings and in the Final Entry and Video; and consents and agrees to the use of the performance in the Recordings on the Track (in whole or part) and in the Final Entry and Video. The Entrant shall complete any and all further paperwork required by the Promoter to grant the rights required under this clause. If anyone else performs in the Recording, the Entrant shall ensure they obtain any necessary consents from such individuals. The Promoter shall be entitled to broadcast, promote, market and otherwise exploit any entry in any manner in all media and shall be entitled to re-edit, alter or modify the same. The Entrant hereby acknowledges that there shall be no fees payable in respect of such assignment or uses and that the consideration given by way of the Promoter promoting such entry constitutes all equitable remuneration.

  1. For the avoidance of doubt, all Entrants agree to the free use of their names, photographs and general locations for publicity and news purposes in connection with the competition in any and all media by the Promoter its licensees, subsidiaries and/or assignees. In addition, by entering this competition Entrant’s shall be deemed to have given their permission for such reasonable publicity.  Such publicity may include winning entries being featured on-line and used generally for publicity purposes, or for articles to be featured in press online or in print.  The Entrant hereby acknowledges that there shall be no consideration payable in respect of such publicity.

  1. In the event that any winning Entrant is under the age of 18 then such win is subject to receipt by the Promoter of a signed consent from the parent/guardian of such winning Entrant to assign and exploit the rights as set out in clause 15 and for the winning Entrant to participate in the prize and Final Entry and Video and the Promoter, its licensees, subsidiaries and/or assigns the right to exploit the Final Entry and Video in any manner and all media as Promoter, its licensees, subsidiaries and/or assignees shall in their absolute discretion see fit.

  1. The Promoter shall be entitled to reject any entry or disqualify any winner or Entrant, if the promoter believes that:

  • the whole or any part of an entry has been copied from elsewhere (other than from the Website);

  • the lyrics in any entry identify any individual that has not agreed to be identified; or

  • the lyrics of any entry are defamatory, indecent, incite hatred based on race, gender, sexual orientation or religion, violate or infringe any third party’s rights; or

  • there is another appropriate basis for exclusion in the circumstances.

  1. Entries submitted may be displayed online at,  and maybe at Selected entries may also be featured on SBTV website ( as part of the competition promotion.


  1. The winning entries will be determined by a mix of popularity (Soundcloud favourings and YouTube likes) as well as the Promoter choosing entries it considers, in its absolute discretion, are the best lyrics/vocals/instrumentals that promote the Peace Mix theme, and promote a positive image.

  1. The Promoter’s decision shall be final and no correspondence will be entered into.

  1. The Promoter reserves the right, with or without cause, to exclude Entrants and withhold prizes for breaching any of these Rules.

  1. The Promoter reserves the right to amend these Rules. Any amendments will be published on the Website.


  1. There will be at least 1 winner although it is expected that there will be a number of winners who will appear on the Track and be invited to Peace Mix Presents finale at The Roundhouse on 28 August  2012. The Promoter may award any number of winners as it sees fit in order to create the Track.

  1. The Winners will be notified on 20 August 2012 by phone or email to the contact details given to the Promoter by the Entrant when entering the competition.

  1. Winning Entrants will be given 3 tickets (including their own) each to attend the Roundhouse event on 28 August 2012. Reasonable travel will be covered for all winners and their two guests and one nights standard accommodation will be provided if the winning Entrant and their two guests are located outside of London.

  1. Winners under the age of 18 must be accompanied by someone over the age of 18.

  1. Prizes are as stated, there is no cash or other alternative to the prizes stated. The prizes are not transferable and no part or parts of the prize may be substituted for other benefit, item or additions.


  1. The Promoter reserves the right to suspend, withdraw or amend this competition, for any reason including but not limited to any unforeseen circumstances or technical or other difficulties that may compromise its integrity.

  1. This competition is governed by the laws of England and Wales and subject to the exclusive jurisdiction the Courts of England and Wales.

  1. Nothing in these Rules shall limit the Promoter’s liability for death or personal injury caused by its employees or agents’ negligence or for fraud.

  1. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.

  1. The Big Lottery Fund has no responsibility or involvement in selecting entrants, judging, or the allocation of prizes and takes no responsibility whatsoever for any damage, loss, injury or disappointment suffered by any Entrant entering the competition howsoever caused.
